- 01Agreement These Terms of Service govern your use of the Jengo property-management platform provided by [COMPANY LEGAL NAME] ("Jengo", "we", "us"). By creating an account or using the service you agree to these terms. If you use Jengo on behalf of a company, you confirm you are authorised to bind that company.
- 02The service Jengo is a software service that helps landlords and property managers in Kenya run their rentals — tenants and leases, invoicing, maintenance, and finance — with rent collection on the **M-Pesa** rail. We are a software provider, not a bank, landlord or estate agent. We do not hold or move your rent: mobile money settles directly through Safaricom to the paybill you configure. We do not currently provide bank integrations, and KRA tax features are **eTIMS-ready** only when you connect your own registered KRA device.
- 03Accounts and your responsibilities - Keep your login credentials secure and enable two-factor authentication where offered. - You are responsible for activity under your account and for the accuracy of the data you enter. - As a landlord or company you are the **data controller** of your tenants' and staff's personal data. You must have a lawful basis to enter and process it, give your tenants any required notice, and use the platform in line with the Kenya Data Protection Act, 2019. Jengo processes that data on your behalf as described in our Privacy Policy.
- 04Fees and billing Paid plans are billed per your chosen subscription (monthly or annual). Free trials, where offered, convert to a paid plan unless cancelled before the trial ends. Fees are exclusive of taxes unless stated. We may change pricing on notice; changes apply from your next billing cycle.
- 05Acceptable use You agree not to misuse the service — including attempting to breach security or another workspace's isolation, uploading unlawful content, or using Jengo to send unlawful communications. We may suspend accounts that put the platform or others at risk.
- 06Availability We work to keep Jengo available and aim for a monthly uptime of **80–90%**, measured on a best-effort basis and excluding planned maintenance and events outside our reasonable control (including Safaricom, network, hosting or power outages). The service is provided "as is" without an uptime guarantee, and downtime does not by itself entitle you to a refund unless required by law or a separate written agreement.
- 07Data and privacy Our handling of personal data is described in our Privacy Policy, which forms part of these terms. You retain ownership of the data you enter; we claim no ownership over it.
- 08Intellectual property Jengo, its software, design and branding are owned by [COMPANY LEGAL NAME]. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your subscription is active.
- 09Disclaimers and liability To the maximum extent permitted by law, Jengo is not liable for indirect or consequential loss, or for loss arising from your data entry, third-party services (such as M-Pesa or KRA), or downtime. Nothing in these terms limits liability that cannot be limited by law. Our total liability in any 12-month period is limited to the fees you paid us in that period.
- 10Termination You may stop using Jengo and close your account at any time. We may suspend or terminate access for breach of these terms or non-payment. On termination we will make your data available for export for a reasonable period, then delete it per our Privacy Policy.
- 11Governing law These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.
- 12Changes We may update these terms; the effective date above shows the latest version. Continued use after a change means you accept the updated terms.
